These Terms of Use (“Terms”) govern your access to and use of the Bella Balloon Childcare Centre website at https://www.bellaballoon.com/ (the “Site”), operated by Bella Balloon Childcare Centre (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Our Privacy Policy explains how we collect and use personal information and is incorporated into these Terms by reference.

1. About the Site

The Site provides general information about our licensed childcare centre in North Vancouver, British Columbia, including programs, news, photos, contact details, and an online waiting list form. The Site is for informational purposes and to help families enquire about care. It does not, by itself, create a childcare contract or guarantee a space in our programs.

2. Eligibility and acceptable use

You agree to use the Site only for lawful purposes and in a way that does not interfere with others or compromise the Site’s security. You must not:

  • Submit false, misleading, or unauthorized information through forms;
  • Attempt to gain unauthorized access to administrative areas, accounts, or servers;
  • Use automated tools to scrape, overload, or disrupt the Site;
  • Upload malware or harmful code;
  • Use the Site to harass, defame, or violate the rights of others.

We may suspend or block access if we believe these Terms have been violated.

3. Waiting list and registration form

The online waiting list form (“Waiting List”) helps families request information, tours, or placement on our waiting list. By submitting the form, you agree that:

  • Information you provide is accurate to the best of your knowledge;
  • You are a parent, guardian, or other person authorized to provide information about the child named in the form;
  • Submission does not guarantee enrolment, a tour date, or a specific start date;
  • We may contact you using the phone number or email address you provide;
  • We may decline or not store submissions that do not meet stated eligibility (including age limits shown on the form);
  • Optional browser draft storage is described in our Privacy Policy and remains under your control until you submit.

When reCAPTCHA is enabled, you must complete it to submit the form. Enrolment fees, deposits, and formal agreements—if offered—are handled separately outside the Site, as described by our staff.

4. No online enrolment contract

Program descriptions, photos, news posts, and availability statements on the Site are subject to change. Final program placement, fees, policies, and contracts are determined through direct communication with our centre and any written agreements you sign with us, not solely through the Site.

5. Intellectual property

Content on the Site—including text, logos, graphics, photographs, illustrations, and the animated sky and seasonal imagery—is owned by or licensed to Bella Balloon Childcare Centre and protected by copyright and other laws.

You may view and print pages for personal, non-commercial use related to considering our services. You may not copy, modify, distribute, publicly display, or create derivative works from Site content without our prior written permission, except as allowed by law.

6. Third-party content and links

The Site may include or link to third-party content and services, including:

  • Google Maps (Contact page, when configured);
  • Public Google review excerpts (News page);
  • Google Analytics and other third-party scripts described in our Privacy Policy;
  • External websites linked from news articles or contact information.

We do not control third-party sites or services and are not responsible for their content, accuracy, or practices. Your use of third-party services is at your own risk and subject to their terms.

7. Decorative and informational features

The Site displays weather-based visuals (for example, sun, clouds, rain, or snow effects) based on approximate local weather data. These features are decorative and may not reflect real-time conditions at our physical location. Do not rely on the Site for safety-critical weather decisions.

8. Disclaimer of warranties

The Site and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, current, or accurate.

9. Limitation of liability

To the fullest extent permitted by applicable law, Bella Balloon Childcare Centre and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of—or inability to use—the Site.

Our total liability for any claim relating to the Site will not exceed one hundred Canadian dollars (CAD $100) or the amount you paid us through the Site in the twelve months before the claim, whichever is greater, except where liability cannot be limited under applicable law (including certain consumer protection laws in British Columbia).

10. Indemnity

You agree to indemnify and hold harmless Bella Balloon Childcare Centre from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms, except to the extent caused by our negligence or willful misconduct.

11. Staff administrative access

Authorized staff may access a restricted administrative area to manage registrations, families, fees, news, and related centre records. That area is not part of the public Site experience. Staff users must keep credentials secure and use administrative tools only for legitimate business purposes.

12. Changes to the Site and Terms

We may modify the Site or these Terms at any time. Material changes will be reflected by updating the “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for disputes arising from these Terms or the Site, except where consumer protection laws require otherwise.

14. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding use of the public Site.
